She criticized the “lies and misrepresentations” she claimed were made by the Republican Forum supported candidates in an effort to dissuade voters’ support of the Bivona and Smith team. The controversial campaign pieces contained allegations that Bivona mismanaged the company for which he was the chief executive. He countered that he was the CFO of a successful Fortune 500 company for 18 years and the CEO of a financial services company that doubled in size over three year period before suffering losses in the mortgage market collapse in 2007. He retired when his contract expired. Among other things, Smith was accused of incorrectly advising the borough on the borough’s affordable housing obligation. He pointed out the minimal number of units constructed in the borough as a result of his counsel, and he dismissed allegations of misconduct in the 1997 dissolution of his legal firm’s partnership, saying the complaint was withdrawn and the matter was subsequently resolved. He was also criticized about the fire department company embezzlement of funds that occurred between 1996 and 1999, but he pointed out that it was he who successfully negotiated the return of all the money that had been embezzled by the former treasurer of the fire department company. Smith also emphasized that he successfully defended the borough against the attempt by an outdoor advertising company to place billboards within the borough.
